Welcome to FloatBuds™. These Terms of Service ("Terms") govern your access to and use of the FloatBuds™ website (www.floatbuds.shop) and your purchase and use of FloatBuds™ products.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR WEBSITE OR PURCHASING OUR PRODUCTS. BY ACCESSING OUR WEBSITE OR MAKING A PURCHASE, YOU AGREE TO BE BOUND BY THESE TERMS.

FloatBuds™ IS A SWIM AID ONLY. IT IS NOT A LIFE-SAVING DEVICE.

  • FloatBuds™ is designed to assist children in building water confidence and is intended to support early swim development.
  • FloatBuds™ is NOT a certified personal flotation device (PFD), life jacket, or life-saving device.
  • FloatBuds™ is NOT approved by any coast guard, maritime safety authority, or equivalent regulatory body.
  • FloatBuds™ does NOT guarantee the safety of your child in water.
  • ADULT SUPERVISION WITHIN ARM'S REACH IS REQUIRED AT ALL TIMES when a child is wearing a FloatBuds™ product and is in or around water.
  • FloatBuds™ should only be used in controlled water environments such as swimming pools and calm, shallow water.
  • FloatBuds™ should NOT be used in open water, oceans, rivers, lakes with currents, or any boating activities.

By purchasing or using FloatBuds™ products, you acknowledge that you have read, understood, and accepted this safety warning and the full terms and conditions below.

2. Product Description and Intended Use

2.1 What FloatBuds™ Is

FloatBuds™ is a children's buoyancy swimsuit designed to:

  • Support early swim development and water confidence
  • Provide 360° buoyancy support around the torso
  • Encourage a natural, horizontal swimming position
  • Offer an alternative to traditional arm floaties

2.2 What FloatBuds™ Is NOT

  • A life-saving device
  • A certified personal flotation device (PFD)
  • A substitute for adult supervision
  • A guarantee of water safety
  • Appropriate for unsupervised water activities
  • Suitable for open water, boating, or water sports

2.3 Intended Users

FloatBuds™ products are designed for children aged approximately 1-6 years old. Please refer to our sizing guide for appropriate fit based on your child's measurements. An incorrectly sized product may not perform as intended.

3. Assumption of Risk and Responsibility

3.1 Acknowledgment of Risk

You acknowledge and understand that:

  • Water activities involve inherent risks, including the risk of drowning, injury, or death.
  • No swim aid, flotation device, or buoyancy product can eliminate the risks associated with water activities.
  • Children can drown quickly and silently, even when wearing flotation aids.
  • The safety of your child depends primarily on active adult supervision, not on any product.

3.2 Your Responsibilities

By purchasing and/or using FloatBuds™ products, you agree to:

  • Provide constant, active adult supervision within arm's reach whenever your child is wearing a FloatBuds™ product in or around water.
  • Never leave a child unattended in or near water, regardless of whether they are wearing a FloatBuds™ product.
  • Inspect the product before each use for damage, wear, or defects.
  • Ensure proper fit according to our sizing guide.
  • Use the product only in appropriate environments (pools, calm shallow water).
  • Discontinue use immediately if the product shows signs of damage or wear.
  • Follow all safety instructions provided with the product.

3.3 Assumption of Responsibility

YOU ASSUME FULL RESPONSIBILITY FOR:

  • The safe use of FloatBuds™ products
  • The supervision of any child wearing a FloatBuds™ product
  • Any and all risks associated with water activities
  • Ensuring the product is appropriate for your child's age, size, and swimming ability

4. Limitation of Liability

4.1 Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOATBUDS LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, MANUFACTURERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • Death, injury, or harm to any person
  • Direct, indirect, incidental, consequential, special, or punitive damages
  • Loss or damage of any kind arising from the use or inability to use FloatBuds™ products
  • Claims arising from improper use, lack of supervision, or failure to follow safety instructions

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if FloatBuds LLC has been advised of the possibility of such damages.

4.2 Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you paid for the specific FloatBuds™ product giving rise to the claim.

4.3 Indemnification

You agree to indemnify, defend, and hold harmless FloatBuds LLC, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of FloatBuds™ products
  • Your violation of these Terms
  • Your failure to supervise a child wearing a FloatBuds™ product
  • Any third-party claims related to your use of our products

5. Product Warranty and Disclaimer

5.1 Limited Warranty

FloatBuds LLC warrants that its products will be free from defects in materials and workmanship for a period of 30 days from the date of delivery, subject to normal use and proper care.

5.2 Warranty Exclusions

This warranty does not cover:

  • Damage caused by misuse, abuse, or neglect
  • Normal wear and tear
  • Damage caused by failure to follow care instructions
  • Products that have been altered or modified
  • Damage caused by improper storage (e.g., exposure to extreme heat or chemicals)

5.3 Disclaimer of Warranties

EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, FLOATBUDS™ PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FloatBuds LLC does not warrant that its products will prevent drowning, injury, or harm. No warranty is made regarding safety outcomes.

6. Orders and Payment

6.1 Order Acceptance

All orders are subject to acceptance by FloatBuds LLC. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

6.2 Pricing

All prices are listed in the currency displayed on our website and are subject to change without notice. Prices do not include shipping, taxes, or duties, which will be calculated at checkout.

6.3 Payment

We accept payment through secure third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.

7. Shipping and Delivery

7.1 Shipping Times

Estimated delivery times are provided at checkout and are not guaranteed. Typical delivery is 2-3 weeks depending on your location. Delays may occur due to customs, carrier issues, or other factors beyond our control.

7.2 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier.

7.3 International Shipping

For international orders, you are responsible for any customs duties, taxes, or import fees imposed by your country.

8. Returns and Refunds

8.1 Return Policy

We accept returns of unused, unworn products in original packaging within 30 days of delivery. Please contact us at contactfloatbuds@gmail.com to initiate a return.

8.2 Refunds

Refunds will be processed to the original payment method within 7-10 business days of receiving the returned product. Original shipping costs are non-refundable.

8.3 Damaged or Defective Products

If you receive a damaged or defective product, please contact us within 7 days of delivery with photos of the damage. We will arrange a replacement or refund at our discretion.

9. Intellectual Property

All content on the FloatBuds™ website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of FloatBuds LLC or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

"FloatBuds" and the FloatBuds logo are trademarks of FloatBuds LLC.

10.1 Eligibility

You must be at least 18 years old to make a purchase on our website. By placing an order, you represent that you are at least 18 years of age.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or products after any changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FloatBuds LLC regarding your use of our website and products.

Full responsibility for the safe use of this product and supervision of your child remains with the parent, guardian, or supervising adult at all times.

By purchasing and using FloatBuds™ products, you acknowledge that you have read, understood, and agreed to these Terms of Service, including all safety warnings and liability limitations.
